Edwards v.

Louisiana's Senate Bill 70 (PDF) would, if enacted, repeal the state's Balanced Treatment for Creation-Science and Evolution-Science Act, which was enacted in 1981 and declared to be unconstitutional by the United States Supreme Court in Edwards v. Aguillard in 1987. Yet the law remains on the books. SB 70 was prefiled by Dan Claitor (R-District 16) on February 17, 2014, and referred to the Senate Committee on Education.

SB70はDan Claitor(共和党District 16)による予備登録され、州上院教育委員会に送られた。

It is Claitor's second attempt to repeal the Balanced Treatment Act. In 2013, he amended Senate Bill 205, which concerned foreign language immersion programs in public school districts, to repeal the obsolete law, and the amended bill passed the Senate, despite the opposition of Ben Nevers (D-District 12), the senate sponsor of the so-called Louisiana Science Education of 2008, who argued that it would be useful for the law to be on the books in case the Edwards decision is ever reversed.

When SB 205 went to the House Education Committee, however, the provision repealing the Balanced Treatment Act was stripped from the bill, in part owing to the bill's original sponsor describing it as "oddball." The Senate rejected the House version of the bill, but a conference committee then agreed on a version of the bill lacking the repeal provision, which was subsequently passed by both houses of the legislature, leaving the Balanced Treatment Act intact.

[Patrick Kingsley: "Scientists sceptical about device that 'remotely detects hepatitis C'" (2013/02/25 on Guardian]

Developers say C-Fast – developed from bomb detection technology – will revolutionise diagnosis of other diseases

The device the doctor held in his hand was not a contraption you expect to find in a rural hospital near the banks of the Nile.

For a start, it was adapted from a bomb detector used by the Egyptian army. Second, it looked like the antenna for a car radio. Third, and most bizarrely, it could – the doctor claimed – remotely detect the presence of liver disease in patients sitting several feet away, within seconds.

"It will change chemistry, biochemistry, physics and biophysics," claimed Dr Gamal Shiha – one of Egypt's most respected liver specialists, and one of the device's developers. Shiha demonstrated its apparent capabilities at the Egyptian Liver Research Institute and Hospital (ELRIAH) in rural Dakahlia, a province in northern Egypt.

[Suzi Gage: "Scientists are not divided over device that 'remotely detects hepatitis C'" (2013/02/27) on Guardian]

Without any peer-reviewed evidence or an adequate explanation of how it works, scientists are rightly sceptical about a device that can diagnose hepatitis C remotely

To claim that scientists are divided over a new device that can remotely detect hepatitis C is akin to claiming that scientists are divided over homeopathy. Yet an article that was tagged as "science" on the Guardian website (though it was posted by Egypt correspondent Patrick Kingsley) did just this. The original headline (which has now been changed) was describing C-Fast: a device, supposedly based on bomb detection technology, that its developer claims will "change chemistry, biochemistry, physics and biophysics".

[Síle Lane: "Hepatitis C detector promises hope and nothing more" (2013/02/28)]

What is being plugged here is hope and nothing more. The device looks like a car radio aerial attached to a handle. It is said to work by detecting a specific frequency emitted by infected liver cells. It is claimed it can detect the disease in a patient from across a room, has never failed to pick up the disease in any patient who has it, and wrongly detects hepatitis where there is none (a "false positive") only 2% of the time.

This degree of reliability is a miracle if you consider that most commonly used blood test for hepatitis C give a false positive result around 15% of the time. No blinded tests have been published, which is surprising given how implausible it is that this new device should work at all, never mind achieve these kinds of detection rates.

The Oklahoma Legislature finds that an important purpose of science education is to inform students about scientific evidence and to help students develop critical thinking skills they need in order to become intelligent, productive, and scientifically informed citizens. The Legislature further finds that the teaching of some scientific concepts including but not limited to premises in the areas of biology, chemistry, meteorology, bioethics and physics can cause controversy, and that some teachers may be unsure of the expectations concerning how they should present information on some subjects such as, but not limited to, biological evolution, the chemical origins of life, global warming, and human cloning.

A bill in Oklahoma that would, if enacted, deprive administrators of the ability to prevent teachers from miseducating students about "scientific controversies" is back from the dead. House Bill 1674, styled the Scientific Education and Academic Freedom Act, was supposed to have died in the Oklahoma House of Representatives on March 14, 2013, when a deadline for bills to have their third reading in their house of origin passed. But it is now listed as available for consideration on the House floor in the afternoon of February 18, 2014. The first antiscience bill in Oklahoma for 2014, Senate Bill 1765, sponsored by Josh Brecheen (R-District 6), is currently before the Senate Education Committee.

House Bill 1674, would, if enacted, require state and local educational authorities to "assist teachers to find more effective ways to present the science curriculum where it addresses scientific controversies" and permit teachers to "help students understand, analyze, critique, and review in an objective manner the scientific strengths and scientific weaknesses of existing scientific theories pertinent to the course being taught," prohibiting administrators from interfering. As introduced, the bill specifically mentions "biological evolution, the chemical origins of life, global warming, and human cloning" as subjects which "some teachers may be unsure" about how to teach.
