法廷闘争で海洋探査を妨害する環境活動家

昨日、カナダのDenny Islandにおける環境活動家による人工地震による地殻構造調査に対する妨害工作を取り上げた。

本日は、海底構造イメージングのための航海が、環境訴訟によって足止めされるという事件をとりあげた、同じくRex Daltonによる2009年8月18日付のNatureの記事を紹介する。

An environmental lawsuit is threatening the departure of a long-planned, US$4.7-million research cruise to image sea-floor structures off the coast of western Canada. The RV Marcus Langseth, a vessel operated by Columbia University in New York for the US National Science Foundation, had acquired all its permits to depart on 21 August for the Endeavour hydrothermal vents, 250 kilometres southwest of Vancouver Island. But on 10 August, the Canadian activist legal group Ecojustice, in Vancouver, British Columbia, sued the university, the Canadian department of fisheries and oceans and the minister of foreign affairs, alleging among other things that proper procedures were not followed in assessing how the seismic air bursts set off during the cruise would affect marine life.

米国National Science FoundationのためにニューヨークのColumnbia Universityがオペレーションを行う船RV Marcus Langsethは、Vancouver Islandの南西250kmのEndeavour熱水噴出孔の調査のために2009年8月21日に出港する許可を得ていた。しかし、2009年8月10日に、カナダのブリティシュコロンビア州Vancouverを本拠地とする環境活動家の法律グループEcojusticeが、手続きが、航海中に行われる地震エアバーストが海洋生物に与える影響のアセスメントに従っていないという理由で、大学とカナダ政府水産海洋省と外務大臣を訴えた。

Cruise co-leader Douglas Toomey, a geophysicist at the University of Oregon in Eugene, says the ship was specifically scheduled and routed to avoid whales, and that marine-mammal observers would be on hand when airguns were fired. As Nature went to press, a hearing on the lawsuit was being scheduled for this week. The cruise plans to sink 64 portable seismometers near the Endeavour vent field, fire airguns into the water for 10 days, then retrieve the data-laden seismometers that pop to the surface. Toomey hopes that the analysis will answer important questions about the flow of Earth's mantle, as well as about earthquakes in the region.

EugeneにあるUniversity of Oregonの地球物理学者で航海の共同指導者であるDouglas Toomeyは、クジラを回避するように科学的にスケジュールおよびルートを定めており、エアガン発射時は海洋哺乳類観測者が近くにいることになっていると述べた。Nature今号発行時点では、訴訟についての聴問会は今週の予定されていた。航海計画では64個のポータブル地震計をEndeavour熱水噴出孔近くに沈め、10日間にわたってエアガンを海中に発射し、浮上させた地震計からデータを取得する。Toomeyはこの分析によって、地球のマントルの流れおよび、この地域の地震についての重要な問題に答えが出ると期待している。

カナダの新聞Times Colonistの2009年8月28日付の報道によれば、この裁判は環境活動組織Ecojusticeの敗北に終わった。

Environmental groups have lost a bid to stop a U.S. research vessel from conducting seismic tests in a marine protected area off the coast of Vancouver Island.

環境グループは、米国の研究船がVancouver Island沖の海洋保護海域での人工地震探査の実施を差し止めようとした裁判に敗北した。

Federal Court Judge Michael Kelen yesterday rejected a request for an emergency injunction to stop the RV Marcus Langseth from firing seismic air guns in the Endeavour Hydrothermal Vents Marine Protected Area.

連邦裁判所判事Michael Kelenは昨日(2009/08/27)に、Endeavour Hydrothermal Vents Marine保護海域でのRV Marcus Langsethによる地震エアガンの発射の緊急差し止めを求める訴えを却下した。

Kelen said in his judgment that measures ordered by the Canadian government are enough to protect marine mammals. But he noted that it was only after the lawsuit was filed that the Department of Fisheries and Oceans increased those measures.

Michael Kelen裁判官は、カナダ政府が命じた対策は十分に海洋哺乳類を保護していると述べた。しかし、裁判官はカナダ政府水産海洋省が対策強化を命じたのは訴訟受理後であったことを注記した。
