報道がなされた日に、豪州最大のホメオパシー団体The Australian Homœopathic Associationが以下のPress Releaseを出して、事件の審理はホメオパシーの有効性を問うものではないと、主張している。

The AHA expresses deepest sympathy for the family of Penelope Dingle at this very difficult time.

豪州ホメオパシー協会はまさに困難な時期にあるPenelope Dingleのご家族に深い同情を表明します。

The AHA is not privy to the full details of the case. However, it would appear that the coronial inquiry is about the management of the case by the husband and the practitioner, not the efficacy of homoeopathy. The AHA takes this matter very seriously and awaits the outcome of the inquiry to understand the nature of the allegations made.

豪州ホメオパシー協会は事件の詳細について知りうる立場にありません。しかし、検死官の審理は夫と開業医による患者の管理の問題についてであって、ホメオパシーの有効性の問題ではないようです。豪州ホメオパシー協会はこの問題を重大に受け止め、疑惑の本質を理解するために審理の結果を待っています。

Homoeopathy is a complementary medicine. It can be used in conjunction with mainstream medicine and other modalities. It is against the Code of Conduct for Homoeopaths to claim that they can cure or treat cancer. However, homoeopathic medicines can be used to support and help to relieve symptoms in cancer patients, in conjunction with other treatments. An integrated health care approach is the most appropriate in cases of severe pathology.

People seeking homoeopathic services should ensure that the practitioner is registered with the Australian Register of Homoeopaths. AROH registered practitioners meet the government endorsed competency standards and are bound by Codes of Conduct. These codes state that practitioners need to refer on or seek a second opinion if the case is not responding to treatment.

ホメオパシー治療を受ける場合は、治療者が豪州ホメオパシー名簿(AROH)に登録されていることを確認してください。豪州ホメオパシー名簿には、政府承認資格に合致し、行動規範を遵守する治療者が登録されています。これらの規範では、治療者は治療しても症状が改善されない場合にセカンドオピニオンを参照するか、セカンドオピニオンを求めることを必要としています。

「審理はホメオパシーの有効性についでではない」とホメオパシーが有効だと間接的に主張しつつ、"can be used"という表現を使って、ホメオパシーが効くかどうか明言しない。「癌を治せると主張することは規範違反」と言いつつ、癌に効くかどうか明言しない。これは、まさにホメオパシーに有効性がないことをわかった上で、ホメオパシーの有効性を否定する報道に対抗しているプレスリリースだ。

AROH登録ホメオパスなら問題がないかのような記述だが、問題のFrancine Scrayenが未登録だとは書かれていない。

についても、有罪の陪審評決が出た時点で、裁判がホメオパシーの有効性についてのものではないというプレスリリースを出している。

[Conviction of Thomas Sam]

Sydney homoeopath, Thomas Sam, and his wife Manju were convicted of manslaughter by gross criminal negligence in June 2009. Their daughter, Gloria, died of malnutrition and septicæmia, complications of severe eczema, in May 2002 at 9 ½ months of age. This is a terrible tragedy, and one can only imagine the immense devastation experienced by Thomas and his family.

The AHA has received emails from members and the general public asking what is being done to defend either Thomas and/or homoeopathy. The AHA would like to make the following statements:

豪州ホメオパシー協会は会員および一般人から、Thomasとホメオパシー擁護のために何をするのかを問うメールを受け取っている。豪州ホメオパシー協会は以下の声明を出す。

• The press have misrepresented and failed to publish the full details of the case, resulting in some negative print media.
  
• The trial/conviction of Thomas and Manju Sam was not about the efficacy of homoeopathy. It was about the negligence of the parents in the general care of their child’s health care.
  
• Thomas is not an AHA member, and is not registered with AROH.
  
• All AHA members are registered with AROH and must abide by the Codes of Conduct of the AHA and AROH, and recommendations or guidelines regarding duty of care. These include the advisability of referring a patient to another therapist or medical practitioner when treatment is not progressing. It is also deemed good practice to not treat your own family in situations other than for first aid or emergencies, and to transfer the care to another independent practitioner as soon as possible.
  
• All NSW ‘unregistered’ health professionals are bound by the NSW Department of Health Code of Conduct, which has similar codes to the AHA and AROH .

AHA Actions:

• The AHA assisted the court with finding an expert witness who could comment on the case from a medical and homoeopathic perspective.
  
• The AHA has responded to the press where appropriate, and will continue to do so, though there is no guarantee that AHA press releases will be published.
  
• The AHA will continue to promote homoeopathy in a positive light to counteract the negative publicity.
  
• The AHA will continue to lobby the government for protection of title for homoeopaths, via a system of co-regulation. This will help to protect the public from practitioners who are not registered, and who do not meet the government-endorsed National Competency Standards.

このプレスリリースでも、ホメオパシーが有効だとは明言されておらず、「裁判がホメオパシーの有効性を問うものではない」とだけ述べている。

そもそもの問題は「ホメオパシーに治療効果がないにもかかわらず、あると思って行動する人々がいる」ことにあるのだが、それには触れていない。いずれの事件も、通常医療にゆだねるべき患者がホメオパスのもとに置かれ続けたことによって起きている。明言すべきは、ホメオパシーに治療効果がないことであり、ないことを前提として何をするかだ。

しかし、豪州ホメオパシー協会にはそんな気はまったくないのだろう。そして、豪州ホメオパシー協会は、引き続き、ホメオパシーにネガティブな報道に対抗して、ポジティブ側から宣伝を行っていく。
