少年の虫垂破裂による死亡は「信仰療法によるものか」をめぐる裁判

2009年3月18日にワシントン州Wenatcheeで、Zachery Swezey(17歳)が虫垂破裂で死亡した。"Church of the First Born"の信者である両親Greg and JaLea Swezeyは、息子を病院に連れて行くことも、救急車を呼ぶこともしなかった。両親は第2級殺人あるいは第1級故殺の罪に問われ、Okanogan郡高等裁判所で裁判が続いている。

In the prosecution’s version, Zachery was a very sick boy, with severe stomach pains, vomiting and diarrhea over the two and a half days leading up to his death. He was so sick he needed help making it to the bathroom, and could not control his bowel. So sick that his parents moved him first to the couch, and then to their own room. And family members came and stayed to help care for him. His fever was so high that he went without clothing, and soaked the sheets with sweat, Okanogan County Prosecutor Karl Sloan told the jury.

In the end he was delirious. He asked for his father. His hands turned blue. His breathing slowed, and he died, Sloan said.

“At no point, even then, was any medical assistance called for. No ambulance. Nothing,” he said.

Doctors who have seen hundreds of cases of appendicitis and dozens of ruptures have never had a patient die of it, he told them. “It’s a preventable death, easily, with medical attention,” he said. “That failure to obtain treatment was the direct and ultimate cause of Zachery’s death,” he told the jury.

The documents say the parents, Greg and JaLea Swezey, gave their son the choice of calling an ambulance and seeing a doctor.

"We don't force our kids, our kids have a choice. At no time did Zachery ask to go to the doctor," Greg Swezey told investigators.

保安官報告によれば、両親Greg and Jalea Swezeyは、救急車を呼び、医師の診察を受けるかどうかを息子に選択させていた。「私たちは息子たちに強制していません。子供たちは選択権を持っています。息子Zacheryが医師のもとに連れて行くよう求めたことはありません」とGreg Swezeyは捜査官に述べた。

しかし、弁護側は大きく違う主張をした。

Korte said the Swezeys thought their son had the flu, and they thought he was getting better. “Ladies and gentlemen, this was not a faith healing death,” he told them.

Korte painted a very different picture. Yes, Zachery came home that Sunday night with a bad stomach ache − bad enough that he woke his parents in the middle of the night, and they set him up to sleep on the couch so they could check on him from time to time. But when he woke up the next morning, the pain in his stomach was gone.

He continued to have flu-like symptoms off and on over the next two days. But he seemed to be getting better. “His sense of humor was back. Mom thought maybe his fever was broken,” Korte told the jury. “He was conversing. He felt good enough to go to his baseball practice on Monday.” Korte said Zachery went to practice but that his coach thought he looked too sick to participate and so he sat on the bench and watched.

The defense lawyer said the boy did not get worse until that Wednesday, the day he died.

Korte弁護士は大きく違う描像を提示した。確かに、Zacheryは日曜夜にひどい腹痛で帰宅し、深夜に両親を起こさなければならない程、ひどいものだった。そして、両親が彼を時々刻々、チェックできるようにソファに寝かした。しかし、翌朝に彼が目覚めると、腹痛はおさまっていた。

その後の2日間、彼はインフルエンザのような症状が出たり、おさまったりしていた。しかし、彼は快方に向かっているように見えた。「彼のユーモアのセンスは回復していた。母親は彼の熱が下がったと考えた。彼は会話をしていた。彼は月曜日には野球の練習に行けるくらい回復したと感じていた。Zacheryは練習に行ったが、コーチは彼が病気に見えたので、練習には参加させず、彼はベンチに座ってみていた。少年は死亡した水曜日までは悪化していなかった。」とKorte弁護士は陪審員に語った。

信仰療法による死亡事件ではないというラインで戦う弁護側。

決着がつくまではどれくらいかかるかわからないが、それまでは、いかにも信仰療法による死亡事件に見えるけれど、事実未確定。
