でも、これも2005年12月20日のKitzmiller v. Dover Area School District of Pennsylvaniaで創造科学と同等扱いで、違憲になった。
しかしそもそも、インテリジェントデザインの父たるPhillip Johnsonもインテリジェントデザインに教える内容がないと昨年発言している：
I also don’t think that there is really a theory of intelligent design at the present time to propose as a comparable alternative to the Darwinian theory, which is, whatever errors it might contain, a fully worked out scheme. There is no intelligent design theory that’s comparable. Working out a positive theory is the job of the scientific people that we have affiliated with the movement. Some of them are quite convinced that it’s doable, but that’s for them to prove…No product is ready for competition in the educational world.ということで、"Teach the controversy"(論争を教える）に方向転換がなされる：
私も現時点で、間違いを含んでいるにせよ、完全に働く記述であるダーウィン理論に比肩するような代替理論に、インテリジェントデザイン理論がなっているとは考えていない。比肩しうるようなインテリジェントデザイン理論は存在しない。肯定的理論を導くことは、私が運動で支援している科学系人材の仕事である。彼らの中には、それが可能だと完全に確信している者もいる。しかし、それを証明するのは彼らである。教育界で競合するために、いかなる生産物も準備できていない。

"I'm not pushing to have [ID] taught as an 'alternative' to Darwin, and neither are they," he says in response to one question about Discovery's agenda. "What's being pushed is to have Darwinism critiqued, to teach there's a controversy. Intelligent design itself does not have any content."でも、「進化はない」という査読つき論文があるわけでもないので、「論争」の存在も示せない。
Discovery Instituteの方針について問われたとき、彼(George Gilder)は「私はダーウィンの代替としてインテリジェントデザインを教えることを推進していない。そして彼らもだ。推進しているのはダーウィニズムを批判することであり、論争があることを教えることだ。インテリジェントデザイン自体に中味はない」と答えた。

なので、「critical analysis of theory of evolution」とか「We think students deserve to know not only about the strengths of modern evolutionary theory, but also about some of the theory's weaknesses and unresolved issues」とか言ってみる。
とは言っても、「進化はない」という査読つき論文があるわけでもなく、最先端の論争に高校レベルでつきあえるわけでなく。
しかも、「進化論は間違っている」のあとに言えることはこんなものしかない。
Arguably, intelligent design can be summarized as the notion that at some point in the past, in some way, some entity(possibly God) created life, or altered life at some point, or created the universe to be compatable with life.これでは中学校の実験レポートにもならない。
おそらくインテリジェントデザインは次のように要約できる。過去のある時点で、ある方法で、ある存在（おそらく神）が生命を創ったか、ある点で生物を改変したか、生物が存在できるように宇宙を創った。[conservapedia:Creationism]
まあ、これでも「わたしの持論なんですが，この知的設計説という「大仮説」はまんざらバカにできないものだと思っています。」とか言っちゃってくれちゃってる竹内薫なら、大いに受け入れてくれるだろうけどね。
