昨日取り上げたオクラホマ州下院の反進化論州法案HB1674だが、2014年2月18日に案文が修正された。提案時点では....
The Oklahoma Legislature finds that an important purpose of science education is to inform students about scientific evidence and to help students develop critical thinking skills they need in order to become intelligent, productive, and scientifically informed citizens. The Legislature further finds that the teaching of some scientific concepts including but not limited to premises in the areas of biology, chemistry, meteorology, bioethics and physics can cause controversy, and that some teachers may be unsure of the expectations concerning how they should present information on some subjects such as, but not limited to, biological evolution, the chemical origins of life, global warming, and human cloning.

オクラホマ州下院に反進化論州法案HB1674-2013復活？

米国の進化論教育及び気象教育を守るNCSEによれば、昨年(2013)に廃案になったオクラホマ州下院の反進化論州法案HB1674-2013が復活した。
A bill in Oklahoma that would, if enacted, deprive administrators of the ability to prevent teachers from miseducating students about "scientific controversies" is back from the dead. House Bill 1674, styled the Scientific Education and Academic Freedom Act, was supposed to have died in the Oklahoma House of Representatives on March 14, 2013, when a deadline for bills to have their third reading in their house of origin passed. But it is now listed as available for consideration on the House floor in the afternoon of February 18, 2014. The first antiscience bill in Oklahoma for 2014, Senate Bill 1765, sponsored by Josh Brecheen (R-District 6), is currently before the Senate Education Committee.

House Bill 1674, would, if enacted, require state and local educational authorities to "assist teachers to find more effective ways to present the science curriculum where it addresses scientific controversies" and permit teachers to "help students understand, analyze, critique, and review in an objective manner the scientific strengths and scientific weaknesses of existing scientific theories pertinent to the course being taught," prohibiting administrators from interfering. As introduced, the bill specifically mentions "biological evolution, the chemical origins of life, global warming, and human cloning" as subjects which "some teachers may be unsure" about how to teach.

成立すれば教師が科学的論争について生徒に対して誤った教育を教師が行うのを当局が阻止するのを禁じるオクラホマ州下院の州法案が廃案から復活した。学問の自由形式の州法案であるHB1674は、2013年3月14日に州下院提案の第3読会の期限切れで廃案になったとみられていた。しかし、今や2014年2月18日午後の州下院本会議で審議対象リストに挙がっている。オクラホマ州の2014年の一つめの反科学州法案SB1765はJosh Brecheen州下院議員(共和党District-6)の提案であり、州上院教育委員会の前にある。

HB1674は成立すれば、州および地域教育当局に「科学論争に関する理科カリキュラムを有効に提示する方法を教師が探求するのを支援する」ことを義務付け、教師が「生徒が、教程にある既存科学理論の強いところと弱いところ客観的方法で理解・分析・批判・レビューするのを助ける」ことを許可することを義務付け、これを妨害することを学校管理者に禁じる。既に紹介したように、この州法案は特に「生物進化と生命の化学起源と地球温暖化とヒトクローン」を教師が教育方法について確信をもっていないかもしれない主題として挙げている。

ヴァージニア州下院の反科学州法案HB207が時間切れで廃案

米国の進化論教育及び気象教育を守るNCSEによれば、ヴァージニア州下院の反科学集法案が、州下院教育委員会と州下院司法委員会の間を迷走したあと、時間切れで廃案になった。
Virginia's House Bill 207 died in the House Education Committee on February 11, 2014, when a deadline for bills to pass their house of origin passed. The bill, which would have deprived administrators of the ability to prevent teachers from miseducating students about "scientific controversies," was previously referred by the House Education Committee to the House Committee of Courts on Justice. Unusually, the latter committee refused to accept the
bill, so it returned to the former committee, which failed to consider it again before the passage of the deadline.

ヴァージニア州下院のHB207が、州下院提案法案の委員会通過期限の2014年2月11日に廃案になった。この州法案は、教師が生徒に「科学的論争」について誤った教育を行うのを、学区管理者が阻止することを禁じるもので、州下院教育委員会から州下院司法委員会に送られていた。通常と異なり、州下院司法委員会は州法案の受理を拒否し、州下院教育委員会に差し戻した。そして、委員会通過期限までに再審議されなかった。

サウスダコタ州上院のインテリジェントデザイン教育州法案SB112が提案者の要請で廃案

米国の進化論教育及び気象教育を守るNCSEによれば、サウスダコタ州上院のインテリジェントデザイン教育州法案SB112が廃案になった。
South Dakota's Senate Bill 112, which would, if enacted, provide that "[n]o school board or school administrator may prohibit a teacher in public or nonpublic school from providing instruction on intelligent design or other related topics," was killed in the Senate Education Committee on February 6, 2014, according to the Rapid City Journal (February 6, 2014).

The bill was killed at the request of its primary sponsor, Jeff Monroe (R-District 24), who told the Associated Press (February 6, 2014) that he decided that it was poorly written: "Some [members of the Senate Education Committee] agreed with the bill, but they would have had to vote against it, based on the fact that it was written poorly."

成立すれば「公立及び私立学校の教師がインテリジェントデザインあるいは関連するトピックの授業を行うことを、学区委員会あるいは学校管理者が禁じることを、禁じる」サウスダコタ州上院のSB112が、Rapid City Journalの2014年2月6日付の報道によれば、州上院教育委員会で廃案になった。

インテリジェントデザインを可能とする条文は、Kitzmiller et al v. Dover Area School District et al(2005)裁判の判例により違憲であるため、成立したとしても裁判で勝ち抜けないことは明らかだった。提案者であるMonroe州上院議員は、それに後から気が付いたのかわからないが、審議日程を浪費するわけにはいかず、審議を断念した模様。

ヴァージニア州下院の反科学州法案HB207が迷走中

米国の進化論教育及び気象教育を守るNCSEによれば、ヴァージニア州下院の反科学州法案が迷走している。
Virginia's House Bill 207, which would deprive administrators of the ability to prevent teachers from miseducating students about "scientific controversies," is in search of a home. On February 3, 2014, the House Committee on Education referred the bill to the House Committee on Courts of Justice on a 14-8 vote. But, unusually, the latter committee refused to accept the bill, so it returns to the former committee, which is expected to consider it again at its February 5, 2014, meeting.

The referral was recommended by the House Subcommittee for Elementary and Secondary Education, which voted 4-3 for it at its January 30, 2014, meeting, according to the Washington Post (January 31, 2014). The bill's sponsor Richard P. "Dickie" Bell (R-District 20), who chairs the subcommittee, was one of the three voting against the referral, so the vote is regarded as a setback for the bill.

「科学的論争」について生徒たちに教師が誤った教育を行うことを、阻止する権限を教育当局から奪うことになるヴァージニア州下院のHB207が審議先を求めて彷徨っている。2014年2月3日に、州下院教育委員会は14:8で、州法案を州下院司法委員会に送った。しかし、異例なことに、司法委員会は受け取りを拒否したため。州下院教育委員会に差し戻された。その後、2014年2月5日の委員会で再審議されることになる。
